GENERAL TERMS AND CONDITIONS

These general terms and conditions of sale exclusively govern all dealings between SEMA, acting through its Tourist Office, and its customers in relation to the sale of tickets.

 Terms and Conditions

Article 1 – General Provisions

Prior to any transaction, the customer expressly acknowledges that they have read these general terms and conditions of sale, which are available at http://www.sainte-maxime.com and may be amended at any time at the discretion of the Tourist Office.

The customer acknowledges that they accept without reservation:

the specific terms and conditions relating to the show (price, seating, timetable, etc.),
the specific terms and conditions relating to online ticket sales (attached),
the specific terms and conditions governing the use of e-Tickets (attached),
the Théâtre de la Mer’s rules and regulations for the Scènes d’été festival (attached),

Article 2 – Points of sale

2.1 – Tourist Office, at the Ticket Office located at 21 Place Louis Blanc, during the Ticket Office’s opening hours and days (04 94 557 555),

2.2 – Tourist Office, via the website https://ticket.sainte-maxime.com, payment by credit card via the secure See Ticket system,

Article 3 – Prices

Ticket prices are quoted in euros, inclusive of all taxes.

Tickets purchased cannot be returned, exchanged or refunded, even in the event of loss or theft, late arrival at the performance, failure to print the e-ticket, or a change to the programme, except in the event of a performance being cancelled (see Article 6).

Article 4 – Collection of tickets

4.1 – For orders placed directly with the Tourist Office’s Ticket Office, tickets will be handed over to the customer in person.

4.2 – For orders placed online via https://ticket.sainte-maxime.com, tickets must be printed by the customer upon completion of the order.

Article 5 – Resale of tickets

Each ticket is named and personal and may only be resold in accordance with the Act of 12 March 2012 No. 2012-348 on the organisation of sporting and cultural events, which prohibits, on pain of criminal penalties, the habitual sale of tickets for cultural or sporting events without the express authorisation of the organiser or the holder of the exploitation rights.

Article 6 – Cancellation and Refunds

In the event of the performance being cancelled, tickets may be refunded at the point of sale where they were purchased.

The Sainte-Maxime Tourist Office may refund tickets purchased at the points of sale specified in 2.1 and 2.2; refunds will only be made to the original purchaser upon presentation of the original ticket, in accordance with the following terms:

For tickets issued at the point of sale specified in 2.1, SEMA will be responsible for refunding tickets issued by the Tourist Office. To do so, tickets must be returned to the Tourist Office’s Ticketing Department within 30 days of the date of the cancelled event. After 30 days, the refund will be handled by the event organiser. It will be the customer’s responsibility to contact the organiser directly. The refund will be paid by bank transfer to the customer within 60 days of the performance’s cancellation.

For tickets issued at the point of sale specified in section 2.2, refunds will be made by crediting the bank card used for payment or by bank transfer.

6.2 – In the event of a performance being interrupted after the first half, tickets cannot be returned, exchanged for another date or refunded.

6.3 – Upon announcement of the cancellation or a change to the date, time or venue of a performance for which the purchaser has booked tickets, the purchaser agrees that the Sainte-Maxime Tourist Office may, where possible, use the contact details provided at the time of booking to keep the purchaser informed of the necessary steps to be taken.

Article 7 – Withdrawal period

In accordance with Article L121-20-4 of the Consumer Code, tickets for performances are not subject to a right of withdrawal.

Article 8 – Personal data

The personal data provided enables transactions to be completed and, where necessary, in the event of cancellation or a change to the date, time or venue of a performance, allows the customer to be contacted.

In accordance with Article 34 of the French Data Protection Act, the customer has the right to access, rectify, object to and delete their personal data. This right may be exercised by writing to the Sainte-Maxime Tourist Office, 21 Place Louis Blanc, 83120 Sainte-Maxime, stating your full name, address and, if possible, your customer reference number.

In accordance with current regulations, your letter must be signed and accompanied by a photocopy of an identity document bearing your signature, and must specify the address to which the reply should be sent. A reply will then be sent to you within two months of receipt of the request.

Article 9 – Disputes

Ticket sales covered by these general terms and conditions of sale are governed by French law. In the event of a dispute, the courts of Fréjus shall have exclusive jurisdiction.

 Special terms and conditions relating to online ticket sales

Article 1 – Preamble

These terms and conditions of sale apply automatically and without restriction to all orders placed for the purchase of event tickets on the Sainte-Maxime Tourist Office website. They are subject to change without notice. The purchase of event tickets by the buyer implies their unconditional acceptance of these terms and conditions of sale as set out by the Sainte-Maxime Tourist Office.

Article 2 – General Provisions

2.1 – The Sainte-Maxime Tourist Office offers a set number of tickets per performance for sale on its website https://ticket.sainte-maxime.com. The Sainte-Maxime Tourist Office reserves the right to increase or reduce the number of tickets on sale at any time and without prior notice.

2.2 – Event tickets remain the property of the Sainte-Maxime Tourist Office until payment has been fully and definitively processed.

2.3 – Your order for event tickets is only definitively confirmed and becomes binding on the Sainte-Maxime Tourist Office upon receipt of the email confirming that the ticket order has been successfully processed. We therefore advise you to check your email inbox.

2.4 – When you click on the ‘Confirm’ button at the end of the ordering process, on the ‘Payment’ page, and indicate your acceptance by ticking the box ‘I accept the terms and conditions of sale’, you are deemed to have accepted the General Terms and Conditions of Sale in full and without reservation.

Article 3 – Prices and Number of Seats

3.1 – The prices of performance tickets (face value) are quoted in euros, inclusive of all taxes.

All orders, regardless of their origin, are payable in euros.

All prices are subject to change without notice but are confirmed on the basis of the price in force at the time of purchase, following our confirmation of the payment requested. No discounts apply after payment for the order has been made.

3.2 – The total number of seats booked per person may not exceed the limit set by the organiser, which will be specified for each event.

A single person may not circumvent this rule by making several purchases at different times.

If the organiser does not specify a maximum number of tickets that may be purchased by a single person, this number is set at five.

Article 4 – Seating, Collection of Tickets and Access to the Venue

4.1 – Depending on the performance, seats may or may not be numbered. Seats are allocated automatically by the software (depending on availability, the system may allocate separate seats to the customer) or by selecting seats on the Théâtre de la Mer seating plan.

By accepting the general terms and conditions of sale, the customer accepts the seating allocation offered to them. Once payment has been made, it is no longer possible to change seats.

4.2 – There is only one way to obtain your tickets: the system generates e-tickets, and the customer is responsible for printing them.

4.3 – Performances begin at the time stated on the ticket. After this time, the Tourist Office cannot guarantee latecomers access to the auditorium or to their reserved seats.

Article 5 – Secure Payment

5.1 – The Sainte-Maxime Tourist Office is only bound by the ticket order upon receipt of an email confirming payment of the transaction. Payment is accepted exclusively online.

5.2 – Tickets purchased on the Sainte-Maxime Tourist Office website may only be paid for by credit card compatible with the operator’s secure payment site. – Payment for tickets by the customer on the website https://ticket.sainte-maxime.com is made solely via the following payment methods, as specified at the time of purchase: CARTE BLEUE/VISA and EUROCARD/MASTERCARD

5.3 – The information provided by the purchaser when entering their bank details is encrypted by the operator responsible for processing the transactions.

Under no circumstances and at no time does information relating to bank cards pass through the network or the Sainte-Maxime Tourist Office’s server.

5.4 – The customer’s bank account will be debited for the amount of the order as soon as the transaction is finally confirmed.

Article 6 – Printing and validity of tickets 

Upon confirmation of the purchase, the customer will receive their e-ticket: a ticket printed at home on A4 paper.

The Tourist Office is not equipped to read tickets displayed on mobile devices. The customer must print their ticket. Failure to do so may result in them being refused entry to the show.

The e-ticket requires a printer to be able to print the ticket on a blank sheet of A4 paper. The customer may print their ticket in either black and white or colour.

The Sainte-Maxime Tourist Office reserves the right to check the customer’s identity at the entrance to the venue where the show is taking place. Customers must therefore carry a valid, official form of photo ID: identity card, passport, driving licence or residence permit. Family record books are accepted for children.

6.1 – Ticket reproduction: It is strictly forbidden to reproduce, duplicate or counterfeit a ticket in any way whatsoever. The reproduction of tickets is prohibited and will not confer any advantage.

The Sainte-Maxime may refuse entry to the Théâtre de la Mer, where the show is taking place, if it becomes aware that multiple printouts or copies of a printable ticket are in circulation and that entry to the venue has already been granted to the holder of a printout or copy.

As the Sainte-Maxime Tourist Office is under no obligation to verify the identity of the person in possession of the home-printed ticket, nor to verify the authenticity of the home-printed ticket, given that a copy of the home-printed ticket cannot be detected; only the first person to present the ticket will be admitted to the venue where the performance is taking place. That person is presumed to be the legitimate holder of the ticket.

In such circumstances, if the holder of a home-printed ticket is refused entry to the venue where the show is taking place, they shall not be entitled to a refund of the price paid.

The person who reproduced the ticket and the user of the copy of the ticket are liable to criminal prosecution.

6.2 – Validity of the ticket: the ticket is valid only for the event to which it relates, on the date, at the time and under the conditions stated on the ticket. This ticket must be retained until the end of the event.

Article 7 – Personal data

The information and data concerning you are necessary for the processing of your order and for our commercial relations. This information and data are also retained for security purposes, to comply with legal and regulatory obligations, and to enable us to improve and personalise the services we offer you and the information we send you.

It is stored on the ticketing server:

– The data is stored in your personal account. This data enables us to complete your transaction. Furthermore, once recorded, this data allows you to carry out future transactions more quickly.

– It may enable us to contact you, where possible, in the event of a cancellation or a change to the date, time or venue of a performance for which you have booked tickets.

Article 8 – Responsibilities

The ticket and the online purchase confirmation must be checked by the purchaser as soon as they are received via email. No subsequent claims will be considered.

Article 9 – Applicable Law – Disputes

The sales referred to herein are governed by French law. Any dispute shall be dealt with by the competent courts.

 Special terms and conditions for the use of e-tickets

The ticket is subject to the general terms and conditions of sale and to the following specific terms and conditions, which you accepted prior to purchasing the ticket.

Article 1 – Conditions of Validity

The e-ticket is only valid if printed on white A4 paper that is blank on both sides.

Good print quality is required. Tickets that are partially printed, soiled, damaged or illegible will not be accepted and will be considered invalid.

In the event of a problem or poor print quality, you must reprint your .pdf or .jpg file.

To check that the print quality is good, ensure that the information on the ticket, as well as the barcode, is clearly legible.

Article 2 – E-ticket verification

Admission to the show is subject to verification of your e-ticket’s validity.

We strongly advise you to arrive at least 30 minutes before the start of the show. During ticket checks, you must present a valid, official photo ID. Furthermore, the price of the ‘standard’ ticket issued to the customer will not always include booking fees.

Article 3 – Use of the e-ticket

The e-ticket is non-exchangeable and non-refundable, unless the Event is cancelled.

The e-ticket is non-transferable. It may be transferred provided that the first name and surname appearing on the ticket are changed via the customer’s Digitick account.

In the event of failure to comply with all the rules set out above, this ticket will be deemed invalid.

 Rules and regulations of the Théâtre de la Mer for the ‘Scènes d’été’ festival

Any member of the audience who fails to comply with the house rules, as well as with certain specific provisions of the venue, may be refused entry to the venue or be ejected from it without being entitled to a refund of their ticket.

Article 1 – CONDITIONS OF ACCESS TO THE THEATRE

1.1 – Access to the Théâtre de la Mer is granted only to spectators (including children) in possession of a ticket.

1.2 – At the entrance to the venue (pre-entry screening), spectators may be required to undergo a security pat-down and, if necessary, present their bags, open, to security staff for a visual inspection.

Access to the auditorium may be refused to anyone who refuses to comply with this security measure.

1.3 – It is forbidden to enter the auditorium with cameras or audio and/or video recording equipment.

These items may be left in the cloakroom at the entrance to the Théâtre de la Mer. SEMA cannot be held liable for any theft or loss of these items.

If the owner of an unauthorised item refuses to hand it over, they will be refused entry to the auditorium and will not be entitled to a refund of their ticket.

1.4 – For safety reasons, it is strictly forbidden to bring onto the premises any weapons, explosive, flammable or volatile substances, bottles, containers, sharp or blunt objects and, in general, any object that could be used as a projectile.

It is also prohibited to bring onto the site any dangerous objects, pyrotechnic articles, or signs and banners of any size of a political, ideological, religious or advertising nature.

For health and safety reasons, it is prohibited to bring food onto the premises.

1.5 – Anyone who is intoxicated will not be permitted to enter the venue.

1.6 – Children under the age of 3 are not permitted on the premises.

Furthermore, SEMA’s Events Department reserves the right, depending on the nature of the performance, to refuse entry to children under the age of 10.

1.7 – Women who are more than six months pregnant are strongly advised not to attend a performance.

1.8 – Animals are not permitted, with the exception of guide dogs accompanying people with visual impairments

1.9 – People with disabilities (regardless of the nature of the disability) are allocated specific seating at the Théâtre de la Mer. They must book their seats in advance at the Tourist Office’s ticket office upon presentation of a disability card.

Article 2 – CONDITIONS OF ACCESS TO THE PERFORMANCE

2.1 – Where seating is on a first-come, first-served basis, the ticket does not necessarily guarantee a seat.

2.2 – In the event of cancellation or postponement of the event, any refund of the ticket will be subject to the general terms and conditions of sale.

2.3 – It is recommended that you take your seat 30 minutes before the start of the performance. Access to the venue and to numbered seats is not guaranteed after the start time stated on the ticket and will not entitle the holder to a refund.

2.4 – During the performance, members of the public are not permitted to stand on the stairs or in the aisles.

Article 3 – PROHIBITIONS

3.1 – Photography, filming or recording is prohibited within the Théâtre de la Mer.

3.2 – Smoking is strictly prohibited within the Théâtre de la Mer.

3.3 – The SEMA Events Department may have any person who disrupts the smooth running of the performance removed from the premises.

3.4 – Spectators are prohibited from engaging in any behaviour that poses a danger to other spectators. The SEMA Events Department reserves the right to eject any offender.

3.5 – Any behaviour and/or visual displays of a racist, xenophobic and/or homophobic nature are prohibited.

3.6 – The use of mobile phones is prohibited in the auditorium during the performance.

Article 4 – FURTHER INFORMATION

Once you leave the venue, re-entry is not permitted, except in exceptional circumstances where a re-entry pass will be issued.
